Workers employed as ‘casuals’ in the black coal mining industry by WorkPac Pty Ltd in the last six years are invited to register their interest.
The matter is being run by Adero Law, a specialist in employment law and class actions.
The class members allege breaches of the Fair Work Act 2009 (Cth) as they have been incorrectly treated as ‘casuals’ under the relevant industrial instruments or alternatively, under the National Employment Standard.
The class members are seeking recoupment of the shortfall in entitlements for annual leave.
Adero Law propose to file proceedings in the Federal Court before the end of 2018.
