Given (1) the average duration and cost of an appeal, (2) the low (statistical) prospects of the appeal succeeding, and (3) the continued uptick in private enforcement (especially in forums where compound interest can be sought), you do start to wonder when a cartelist’s cost-benefit analysis will point it towards discussing redress vs launching an appeal!”
