Head of Competition, Simon Latham, gives his views on The Times news article titled ‘Most companies lose EU competition appeals’.

 

Simon Latham commented:

 

“Interesting analysis from PaRR on success rates in appeals of liability in cartel decisions, reported in The Times here. Given (1) the average duration and cost of an appeal, (2) the low (statistical) prospects of the appeal succeeding, and (3) the continued uptick in private enforcement (especially in forums where compound interest can be sought), you do start to wonder when a cartelist’s cost-benefit analysis will point it towards discussing redress vs launching an appeal!”
